Sen. Rand Paul Defends Property Owners from Federal Agencies

U.S. Senator Rand Paul (R-Ky.) has just introduced legislation designed to rein in out-of- control federal agencies such as the Environmental Protection Agency (EPA) and the Army Corps of Engineers. The bill, if enacted, will be a vital blow to the enforcement of radical environmental/Agenda 21- inspired regulations. The bill is called the Defense of Environment and Property Act of 2012 (S.2122).

A little history: in 1972, as the environmental movement was getting its start through popular efforts to stop pollution in our rivers and air, Congress passed the Federal Water Pollution Control Act (later called the Clean Water Act).The law prohibited the discharge of pollutants into “navigable waters” without a federal permit. The problems began when the EPA and the Army Corps of Engineers made a power grab by enforcing the act over ponds, occasional mud puddles, and even dry lands by labeling them as wet lands.

The result has been disastrous to property owners and businesses, sometimes even leading to jail sentences to “violators.”

The result of such outrageous interpretations of the Clean Water Act has led Senator Paul to introduce his bill to do the following:

Redefine “navigable waters” to explicitly clarify that waters must actually be navigable in fact, or “permanent, standing, or continuously flowing bodies of water that form geographical features commonly known as streams, oceans, rivers and lakes that are connected to waters that are navigable — in fact.”

  • Excludes ephemeral or intermittent streams — the streams that sometimes form when rain falls — from federal jurisdiction.
  • Restrains the EPA and Army Corps from regulating or “interpreting” the definition of a navigable water without Congressional authorization.
  • Protects the rights of states to have primary authority over the land and water within their borders.
  • Prohibits federal agents from entering private property without the express consent of the landowner
  • Requires the government to pay double the value of the land to any landowner whose property value is diminished by a wetlands designation.

Why is it necessary to write such juvenile-sounding legislation to define what any reasonable person should already understand? Who doesn’t know what a river is? Apparently the EPA and Army Corps have little regard for such details as they zealously attack private property in the name of environmental protection. American citizens have been literally terrorized by these agencies and the consequences have been dire.

Some examples:

  • Florida resident Ocie Mills planned to build a dream house for his son. He brought in 19 loads of clean building sand, cleared a dry ditch and began filling the ditch with sand to level the ground for the foundation. The Army Corps of Engineers sent him a notice demanding he immediately stop the fill because they considered the property to be a wet land. The Florida Department of Environmental Regulations (DER) sent out an agent who determined that the land was not a wetlands. Ocie resumed dumping fill on the foundation site. The Army Corps disagreed and sent US Marshalls to arrest Ocie and his son. In a trial with no legal representation Ocie was not allowed to submit evidence that the DER did NOT consider his land a wetland. As a result a panel of three federal judges sentenced both Ocie and his son to 21 months in jail with no parole and a fine of $5,250 each. Six years later in a retrial a judge ruled that the land was not a wetlands.
  • John Pozgai served a three year prison term for violating the Clean Water Act on his property in Pennsylvania. His crime? Pozgai, a first generation immigrant who escaped communist Eastern Europe, bought property that was being used as an illegal dump. The dump contained a storm water drainage system and a storm water drainage ditch dating back to 1936. The township was responsible for maintaining the drainage ditch but failed to do so, and that failure caused flooding on the adjacent road and in the Pozgai home. It had done so for 20 years. When Pozgai bought the land he began to clean out thousands of dumped tires, many of which were blocking the storm water drainage ditch. The Army Corps of Engineers declared the standing water caused by the plugged drainage ditch to be a wetlands. John Pozgai, who survived the tyranny of communism, couldn’t beat the outrages of environmental zealots empowered with the force of government, which refuses to recognize private property rights.
  • Charlie Johnson’s family has been growing cranberries on his small farm near Carver, Massachusetts since the 1920s. The federal government prepared to take Johnson to court, claiming that many of the cranberry bogs were created in violation of the 1972 Clean Water Act. The EPA asked for permission to enter Johnson’s property to collect data. Johnson gave his approval, believing he had nothing to hide. He later discovered that the EPA wanted to return his land to wetlands under the assumption that wetland conditions existed on the property before Johnson’s cranberry bogs were constructed. He explained the bogs were originally constructed on dry sandy land that formerly contained a variety of forested uplands. The EPA based its theory on a number of small aerial photos taken during spring thaws when much of the land is underwater because of melting snow. If Johnson loses his case he will be forced to destroy his cranberry bogs and convert his property to artificial wetlands.

These are just a very few examples of the tyranny raining down on honest Americans who are simply trying to use their land and live in peace. When confronted by government officials they went to the “proper” authorities to assure they did the right thing. Many times they were misdirected by those very government agents and then trapped by it. Then they were fined, harassed and some went to jail for their “crimes.”

There is no room in a free society for such power-mad zealots in our government. Senator Paul’s bill is designed to bring a semblance of sanity and reason back to environmental regulations.

The EPA, Army Corps and other agencies of the government have been using the intimidation of government power to enforce the policies of Agenda 21 and Sustainable Development. These policies do not recognize private property rights and they have made a sham out of the rule of law and the court system, replacing it with rule by edict. Until now these outlaw agencies have terrorized American citizens without interference or control by their rightful masters — Congress.

However, little by little, in state legislatures and now in Congress, new legislation is being proposed to return sanity and control. Senator Paul’s Defense of Environment and Property Act is a start. It must be supported by everyone who professes allegiance to the Constitution and to the Republic for which it stands. With such action, step by step, we can restore that Republic of our Founders. Call your Senators and demand they support S.2122.

Please support this bill and reign in government power.

GOP Primary Propaganda…

I haven’t talked a lot about the Republican primaries and who running, who’s got good ideas and what I think, you’re grown think for yourself… but one thing I will talk about is the amount of political junk email I get from campaigns and their respective supporters. Every day I get e-mail from Paulies, Mittens and Newter mostly and very few the Santorum crowd.

So do me a favor and just stop it… I don’t read them – I delete them, I’m informed and can find the facts. Besides by the time the Kentucky Primary rolls around in late May the candidate is nearly always decided anyway and the vote in my state doesn’t matter. So you are wasting your energy and I’m frankly sick of seeing all the infighting on our side. We’re not the enemy.

The GOP does this every time, they so bloody one another that they go into the election battle weary and scarred – meanwhile the opponent has been out there running them in the dirt right along with the rest of the pack – so why keep destroying one another? Focus on the problem… Barack Obama, saturate the airwaves with everything Obama has done to screw this country up and promote how any of them would be better than him. Counter the propaganda being but out by the left about how everything is just rosy and our perception of a weak economy is false.

Apparently in Obama’s world gas, food, utilities, basic haven’t skyrocketed in price over the last three years – well they have in mine and millions of other Americans, point it out and rub it in. Obama say unemployment is down while the CBO that Obama loved to cite says ‘No, it’s not… it’s actually up‘ – stop destroying one another and focus on the problem!

Because I’m sick of the infighting and I’ll vote for Skippy the Wonder Dog or Fluffy the Dust Bunny in the Corner long before I vote for the  Marxist/Socialist Obama.

As for the candidates…

Romney – wishy-washy and a fake conservative easily swayed by libtard views prone to saying something stupid and created RomneyCare, but smart on the economy and jobs.

Gingrich – finger in the wind riding on the coat tail of the theme of the moment with more baggage then the buggy can carry, but sharp as a tack on government workings and would follow the populous opinion, great debater.

Paul – fruitcake crazy on foreign policy and isolationism comes off as the crazy uncle, but when dealing with the value of the currency and economy he’s a genius.

Santorum –  has a likability issue and his snarkiness will turn many off and may be a bit to much of a social conservative, but has smarts on both the economy and foreign policy.

I could go into more detail on their Pro’s and Con’s as there are many – that’s just the highlights as I see it, your views may vary and I guess if you put them all in a blender and poured off the grease you’d have a palatable candidate.

I’m not behind any of them right now, but one I will support in November.

How to cheat at Burgoo…

Here is something non-political…

The first thing you are saying is… WHAT THE HELL IS BURGOO? There might be a dozen or so people that read this blog that know what I’m talking about.

Burgoo is a  BBQ soupy-stew dish that has as many recipes and cooking methods as there are people that eat it! It is made from nearly anything you can hunt, gather or grow.  Here we have a bunch of festival for burgoo so it’s not all that obscure regionally. Now normally Burgoo is cooked long and slow in a large iron kettle outside over wood fire with fresh ingredients and can be cooked as long as a full day or more – so cooking it becomes more of a social gathering than anything else.

Burgoo is a ugly food that taste great… it normally met with the phrase ‘Do we eat it or did we eat it?’ It’s not a pretty food as most cooks will attest and reading most recipes even ones for so called small amounts still makes a lot.

But say you want a little Burgoo and you don’t want to make 30-100 gallons and spend a day and a night doing it… you can cheat!

Here is my cheater version of the rather long and complicated versions that gets pretty damn close to the real flavor of the dish. I had some left over BBQ pork and I did not want another damn BBQ sandwich so it was time to mix it up a bit with something different.

First make a 3 or 4 lbs pork roast (you can use or add cooked shredded chicken too or omit the pork for chicken entirely if you are Jewish or have some other aversion to pork) one night in a slow cooker and enjoy you meal but save about a pound or so of it for the burgoo and when it cools shred it by hand and stick it in the fridge as likely you are already full from the rest of the pork.

Now take the cooked shredded pork/chicken and warm it up in a 3 or 4 qt pan, turn the heat down to medium and pour a couple of cans of mixed vegetables in the pan and gently mix with the pork/chicken. You can also add a small can of Southwest or Mexican Corn or whatever you like. Okay, just when you see a little steam coming off of it turn the heat down to low and pour in some cheap regular old BBQ sauce… say 10 oz or so and continue to cook on low for 30 mins. Stirring occasionally.

Now test it… does it need more BBQ sauce if so add it… maybe salt? Pepper? Tabasco? Veggies? Meat? Whatever you need to make the flavor you like.

For me I use about 2 packed cups of shredded BBQ pork, 2 cans of Veg-All, 1 can southwest corn, one 12 oz bottle of cheap BBQ sauce and cook on low for 30-60 mins stirring regularly and then eat! If it is too thick (too stewy like) add some chicken broth to thin. This gets real, real close to the flavor of  real burgoo without needing a small army and a full day to make.

Try it you just make be surprised… or as I say when I cook something different “This will either be good or the dogs will eat well.”

Just in case you want to know, here is one of the many full versions of a Burgoo recipe.

Ingredients:

1 pound lamb shoulder roast, cut into 1″ cubes
1/2 pound pork butt, cut into 1″ cubes
1 1/2 pounds chicken leg/thigh quarters
1 quart beef stock
1 quart chicken stock, plus 2-4 quarts more
1 cup unpeeled red potatoes, medium diced
1 cup red onion, medium diced
1 cup lima or fava beans (frozen are OK)
1 cup diced green peppers
1 cup diced, peeled carrots
1 cup corn kernels (frozen are OK)
1 ounce Ancho chilies, toasted, seeded,
stemmed and cut into small pieces
1/2 teaspoon cayenne
1 1/2 teaspoons kosher salt
3/4 teaspoon pepper
1 cup sliced okra
4 large garlic cloves , minced (more to taste)
2 cups canned chopped tomatoes
2 tablespoons cider vinegar
2 tablespoons lemon juice
3 tablespoons Kentucky Bourbon, more to taste (Susan likes to use Jim Beam)
12 tablespoons Worcestershire Sauce
1 tablespoon hot sauce
1/2 cup parsley, chopped

Directions:
Cut excess fat from chicken legs, leaving skin intact. Combine lamb, pork and chicken in large stockpot with beef and chicken stock. Bring to a full boil and skim any froth or gray foam from the top. Reduce the heat and simmer for 2 hours. Remove the chicken legs and let cool. Remove skin and bones, shred chicken meat and return to pot. Add potatoes, onions, beans, green pepper, carrots, corn chiles, cayenne, salt and pepper. Simmer another 3 hours, adding 2-4 quarts of chicken stock, as needed, to keep stew from getting too thick.

After 3 hours add okra, garlic, tomatoes, vinegar, lemon juice, bourbon, Worcestershire sauce, and hot sauce. simmer another 6 hours, adding chicken stock if necessary.

Add parsley after burgoo is cool. Finished burgoo should have a soup, not stew consistency and must cook 12 hours. Can be started one day, cooled quickly and finished the next day. Refrigerate overnight to mellow the flavors and make the removing of fat easier.

Tenacity – the true path to riches case in point, Harland Sanders

Let me tell you about my homeboy Harland Sanders aka Colonel Sanders of Kentucky Fried Chicken fame.

I’m not going to write a big long piece on his life I’m just going to hit the high points for this libtards that think you have to be born into money to make it.

Born September 9, 1890 into a poor home in  Henryville, Indiana.
His father died when he was 6.
Sanders dropped out of school in the 7th grade – never to return.
Sanders ran away from home at 16 because of beating by his step-father, lied about his age and joined the Army.
Spent the next 20 years in and out of various jobs from steamboat pilot to railroad firemen to farmer.
Didn’t start cooking chicken until age 40 in 1930.
Opened a small restaurant along side a filling station and motel.
Slept in the back room of his business.
In 1939 Sanders restaurant burned to the ground he rebuilt and reopened within months.
His fried chicken grew in popularity a long trucking route in Corbin, Kentucky.
With the coming of I-75 Sanders saw the writing on the wall and began markets if chicken.
Over the next few years Col Sanders called on 1010 restaurants to sell his fried chicken method – he was rejected 1009 times.
In 1952 at age 61 in South Salt Lake, Utah – and after knocking on 1010 restaurant doors Col Sander’s got Peter Harmon to open the first Kentucky Fried Chicken franchise
In 1955 at age 65 his original business in Corbin failed due to the trucking and traffic moving to the new Interstate 75
Selling all of his property in Corbin and paying off his debts Sanders was nearly broke again.
He took his first social security check of $105 and hit the road to continue to sell his franchise.
Over the next 9 years Sanders continued to sell and develop his Kentucky Fried Chicken franchise brand and image.
By 1960 Sanders had 190 KFC franchises and 400 independent franchises in the US and Canada.
In 1964 at age 74 his sold his American interest in KFC to fellow Kentuckian John Y Brown Jr for $2 million (about $15M today)
Sanders kept the Canadian Operation and many of the US franchise rights such as his own image which made him a lot more money.
Sanders invested heavily with his new found wealth in Kentucky Fried Chicken proving profitable.
Until his death in 1980 Harland David Sanders continued to be the spokemen for KFC and to this day is still the face of it.
Today KFC has 15,000 restaurants in 109 countries and it all started with a 7th grade drop out from a poor family in rural Kentucky.

Sanders was a senior citizen before he made it… he started with nothing and today there are few in the world who don’t know who he is… so when your liberal idiot friends say you need a Ivy school education or to come from a rich family to make it… call it what it is – bullshit.

Bridge over the River Propaganda…

As a lot of you folk know I live in the great state of Kentucky… the 6th poorest state in the nation – yeah for us! Obama has been running about touting his AMERICAN JOBS BILL – that’s not a bill because the Democrat haven’t introduced it and Louie Gohmert took the name of the bill for his own… anyway Obama is going to be in a Kentucky/Ohio today to blah, blah, blah another propaganda speech about jobs and infrastructure at the Brent Spence Bridge that Obama claims needs to be replaced right now… well it doesn’t.

Let’s check some facts… the Brent Spence Bridge is between KY and OH – but it’s not about to fall down, it’s not crumbling, it’s not in disrepair or in need of replacement, in fact it’s fine! The only problem with the bridge is the traffic volume because it is in fact a major trucking route that carries more traffic per day than it was originally designed to carry 40 years ago and Obama runs around acting as if it’s going to fall in the river at any moment – when the actual plan is to add another bridge to relieve some of the traffic volume – meaning the bridge doesn’t qualify of the jobs plan because it’s not in immediate need of repair or replacement which according to Obama his second stimulus American Jobs bill is designed to do… just like the first trillion dollar one was.

It’s nothing but a propaganda bridge.

But don’t take my word for it – others agree -

The president’s jobs bill is designed for “immediate” highway spending.

And the new $2.3 billion Cincy bridge is not scheduled to even start construction for probably four years, long after Republicans have scheduled the Obama presidency for completion.

And without delays, it wouldn’t be finished until 2022, when no one will be counting Obama’s rounds of golf.

Politicians hate these kinds of messy distractions when they pick a place to make a symbolic statement. But Brent Spence was so tempting linking, as it does, the home states of GOP House Speaker John Boehner and Senate Minority Leader Mitch McConnell.

Surely Obama is not just playing politics and making campaign stops at Boehner and McConnell’s home states on the taxpayers dime (BTW that’s a violation of Federal law). After all if it’s not a campaign stop then why is he making the speech in Ohio and not Kentucky where the bridge is 99% located? See the Ohio River is in Kentucky because we were a state when the surrounding  states became states placing the northern boarder of the river as of 1792 in Kentucky… ergo the river and the bridge are in Kentucky but Ohio has more electoral vote and  Obama’s chances of winning Kentucky are zero. (He lost it in 2008 when he was popular)

So nothing new here folks, Obama is out lying and ginning up division while trying to save his job.

The Reality of the Amish Buggy… it’s about safety.

This story is a local story that has gone national… I’ve seen it on Fox, CNN, Drudge, The Blaze, Daily Caller and several others. I’ve read 100′s of comments both left and right and it amazes me just how stupid both sides can be, a few get it but most are clueless. Why? Because they don’t live here and they don’t understand it…

Now keep in mind the Amish do NOT pay a road tax, vehicle tax, usage tax or any tax for that matter so their using the roads is a privileged and not a right. They want to be apart and separate from the rest of the folks here until they need to use the road, the hospital, the police, the fire department or other public services they pay no taxes or fees to support.

Religious Discrimination? 8 Amish Men Jailed After Refusal to Post Safety Signs on Buggies

In a story that perfectly illustrates the potential clash between religious adherence and government policy, nine Amish men who refused to display an orange reflective triangle on their horse-drawn buggies have been ordered to jail for not paying court-imposed fines.

The men belong to the ultraconservative Old Order Swartzentruber Amish sect in western Kentucky. While other Amish sects in the area do comply with the regulation, the especially-strict order objects to the triangles because the bright color violates their modesty code.

The Courier-Journal reports that the men say paying the fines would amount to complying with a law they believe violates their religious strictures. Levi Zook, one of the individuals who was sentenced, explained to the court his views on the matter.

“I don’t think it’s right to put somebody in jail for practicing their religious beliefs,” he said. “But that’s what we’ll do if that’s what it takes to abide by the biblical laws.”

Here is the deal.. it’s an safety issue – PERIOD! You want to obey your religious beliefs Levi… stay off the damn roads! I live here and I see these buggies all the time and if you come up on a black buggy traveling 3 MPH on a blacktop road and you are driving a car or truck traveling  55 MPH – you don’t see them until you are on top of them. We have a lot of tree lined roads in the country and they are dark at all times of the day. We’ve had several Amish killed of injured in traffic accident because when buggy verses vehicle the buggy loses every time and without a safety triangle they will get closer to God in a hurry.

I’m a Libertarian, I believe in less rules and far less government regulation – but I have common sense and I use it. The Amish are ignoring common sense and someone else is going to be killed and then they’ll want to file charges against the “outsider” because they couldn’t put a damn triangle on their buggy!

Another point – we use to require safety lights… red running lights powered by battery the Amish protested and fought that so us “modern folks” compromised with the agriculture safety triangle and now they are protesting that… the community has to draw the line somewhere. Let me tell you I generally like the Amish and know a few, but they can be bigger hypocrites than Liberals – remember the 5 Amish guys drunk and groping little girls? Would these morons defend them if they said that was a religious right?

Here are a couple of the idiotic arguments I’ve heard…

“Well what about cars with burnt out taillights?”
That’s illegal too and a car is bigger, traveling at the same speed, still illegal but less like to cause an accident.

It’s a violation of their religious right!
If they don’t want to have a safety triangle on their buggy then stay off the roads… no one is forcing you to travel on the roads.

It’s government oppression!
No it’s common sense – if you are traveling at 3 MPH on a road with cars traveling 55 MPH you are a hazard and at risk!

Now this is the same evil “modern” community that came together to help the Amish when they tried to cross a flooded stream and several of their children were washed away…

The local community held fund raiser and helped the Amish family in many, many ways. So the least they can do is obey the damn traffic laws and put a safety triangle on their buggy.

Just a thought – what if I said it was my religious belief to drive as fast as I want? Or ignore stop signs or stop lights? Would I have a right do drive like idiot and  I own the road and the rules of the road don’t apply to me? Like I said no one forces them to use the roads… so if they do they have to follow the rules. It’s like this they need Ag safety triangles on their buggies and they can’t grope little girls.

It’s that simple.

Kentucky Governor Steve Beshear doubled unemployment

Kentucky Governor Steve Beshear is running for re-election this year, he seems to think he is worthy of a second term. He claims he created or saved nearly 20,000 jobs in Kentucky… he even has a list about his  creating jobs for Kentucky what Beshear doesn’t tell you is that when he was elected in Nov 2007 unemployment in Kentucky was 4.9% and today it’s over 10.2%! Do I really need to do that math for you on that?

And that’s creating of saving jobs? Nope, that’s bullshit.

Little Stevie says…

Since then Beshear has helped bring hundreds of projects totaling more than $2.2 billion in potential investment into the Commonwealth. The developments represent nearly 19,500 jobs created or saved.

Crated of saved… well “or saved” is bullshit so we’ll toss those out right away. So based on the news release for Kentucky I’ve seen the number of job actually claimed to be created is closer to 8000 or 9000 – but he doesn’t list a single job lost while he was governor. Here in my own county General Tire closed it’s doors and puts over 2000 people out of work and many smaller uncounted support companies went belly up too. None of those jobs have been replaced and if I count the closed stores, restaurants and small businesses it’s a lot more in a county of 30,000 and the biggest town of barely 10,000… 2000-3000 jobs lost is about 10% of the population not the work force. Oh and by the way General Tire closed because the UNION wouldn’t deal – so they closed. Thanks Unions.

so anyway…

The reality is real simple if unemployment goes from 4.9% when you took office to 10.2% today you haven’t created or saved a damn thing. Apply this logic to idiot claiming to have created or saved jobs.

It’s like this if I had a $100 and I lost $15 but somehow I manged to save or create $5 – I’m still lost $10 – but if I was Beshear or Obama I’d want you to praise me and re-elect me for loosing 10% of my money – ridiculous.

So all Steve Beshear did using his own numbers is double unemployment in Kentucky and believe me a know a lot of folks out of work.

Bin Laden was located at a compound in Abbottabad, Pakistan, which was monitored and when the time was determined to be right, the president said, he authorized a “targeted operation.”

“A small team of Americans carried out the operation,” Obama said. “After a firefight, they killed Osama bin Laden and took custody of his body.”

DNA testing confirmed that it was bin Laden, sources told ABC News.

Sources said the attack was carried out by Joint Special Operations Command forces working with the CIA.

Where is the body? Do you think the loony left would accept DNA testing if Bush was in charge? Hell No? I want to see this assholes head on a pike, I want to see his dead bloated corpse covered in pig blood impaled at ground zero, but nooooo we have to bury him within 12 hours according to Islamic Law. And for all those idiots running around talking about how great Obama is now, how Obama can’t be beaten now and how as Joy Behar is saying we should just skip the 2012 election… remember this!
